You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4. User Content

You retain ownership of any Content that you upload to the Service. By uploading Content, you grant Canvus.ai a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such Content for the purpose of providing and improving the Service.

You represent and warrant that: (i) you own the Content or have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

5. Generated Content and Intellectual Property

When you use our Service to generate content:

• You receive a license to use the Generated Content for personal or commercial purposes, subject to the restrictions in these Terms.
• Canvus.ai retains ownership of the underlying AI models, algorithms, and systems used to create the Generated Content.
• You may not claim copyright or trademark rights in Generated Content as-is.
• You may not use Generated Content to create products or services that compete with Canvus.ai.

6. Intellectual Property Respect and Compliance

Respecting Third-Party IP Rights

You agree to respect the intellectual property rights of others when using Canvus.ai. This includes:

• Not using prompts that intentionally attempt to generate content that infringes on copyrights, trademarks, or other intellectual property rights of third parties.
• Not using Canvus.ai to create derivative works of copyrighted materials without proper authorization.
• Not uploading reference images or content that you do not have the rights to use.
• Not using Generated Content in a way that falsely implies endorsement by or association with third-party brands, characters, or personalities.
• Understanding that AI-generated content may inadvertently resemble existing works, and taking appropriate precautions before commercial use.

Commercial Use Guidelines

If you intend to use Generated Content commercially:

• You are responsible for conducting appropriate clearance procedures and due diligence to ensure the Generated Content does not infringe on third-party rights.
• Consider seeking legal advice before using Generated Content in commercial products, marketing materials, or other public-facing applications.
• Be aware that certain industries (such as pharmaceuticals, financial services, and legal services) have specific regulations regarding advertising and representations that may limit your use of AI-generated content.

Attribution and Transparency

We recommend:

• Being transparent about the AI-generated nature of content when appropriate, especially in contexts where authenticity is material.
• Not misrepresenting AI-generated content as human-created when doing so would be misleading or deceptive.

Indemnification for IP Claims

You agree to indemnify and hold harmless Canvus.ai from any claims arising from your use of Generated Content, including intellectual property infringement claims resulting from your prompts, modifications to Generated Content, or your use of Generated Content.

7. AI Limitations and Responsible Use

AI Accuracy Disclaimer

You acknowledge and agree that the AI technology used by Canvus.ai is not 100% accurate and may produce content with errors, biases, or inaccuracies. Generated Content should be reviewed carefully before use.

Responsible Use

You agree to use Generated Content responsibly and with appropriate caution. This includes:

• Verifying any factual claims or information contained in Generated Content before relying on it for important decisions.
• Not using Generated Content in ways that could cause harm, spread misinformation, or deceive others.
• Understanding that AI-generated images may contain artifacts, inconsistencies, or unrealistic elements that require human review.
• Not using Generated Content to impersonate real individuals without their consent or create deepfakes intended to deceive.

Legal Compliance

You are solely responsible for ensuring that your use of Generated Content complies with all applicable laws and regulations. You agree not to use Generated Content for any illegal purposes, including but not limited to:

• Fraud, deception, or misrepresentation
• Harassment, defamation, or invasion of privacy
• Copyright or trademark infringement
• Creating or distributing illegal content
• Circumventing security measures or accessing unauthorized systems

8. Prohibited Uses

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable.
• Generate content that infringes upon or violates the intellectual property rights or other rights of any person.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
• Use the Service for any purpose that is illegal or prohibited by these Terms.

9. Limitation of Liability

In no event shall Canvus.ai, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage of any nature whatsoever resulting from your access to and use of the Service; (iii) any unauthorized access to or use of our secure servers and/or any personal information stored therein; (iv) any interruption or cessation of transmission to or from the Service; (v) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through the Service by any third party; and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Service, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.

10. Indemnification

You agree to defend, indemnify, and hold harmless Canvus.ai, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
